Artist Agreement

SOLENE HAUS is for original, human-made art. AI-generated work is not allowed. If you list AI art, your storefront will be taken down.

1. Who this agreement is between

This Artist Agreement ("Agreement") is between you (the "Artist") and SOLENE HAUS Pty Ltd ("SOLENE HAUS", "we", "us", "our"). It governs your membership, your storefront at solenehaus.com/yourname, and everything you list, publish or sell through the platform.

By creating an artist account, paying for membership, or listing any work, you accept this Agreement in full. It sits alongside our Terms of Service; where the two touch on the same subject, the stricter wording applies.

2. Original, human-made work only

2.1 You confirm that every work you list is your own original creation, that you hold full copyright and intellectual property rights in it, and that you have the right to sell it.

2.2 Every work must be made by a human being - you. SOLENE HAUS is a platform for original human art. Work that is not your own, that infringes copyright, or that misrepresents its authorship or how it was made is prohibited.

3. No AI-generated art (zero tolerance)

3.1 AI art is not permitted on SOLENE HAUS. You must not list, upload, sell, or promote any work that is generated, in whole or in part, by artificial intelligence, machine-learning image generators, or any automated text-to-image, image-to-image, or generative system. This includes, without limitation, tools such as Midjourney, DALL-E, Stable Diffusion, Adobe Firefly generative fill, and any comparable generative model, whether the output is used directly or as the basis of a work.

3.2 What is still allowed. Ordinary, non-generative digital tools remain fine: photographing or scanning a physical piece, colour-correcting, cropping, straightening, dust or blemish removal, and standard non-generative editing of your own photographs and hand-made digital work. The line is simple - the creative content of the work must be made by you, not generated by a model. Generative "fill", "expand", or "create" features are not permitted.

3.3 Disclosure and cooperation. By listing a work you represent that it contains no AI-generated content. On request you must be able to show your process - working files, layers, sketches, references, timelapse, or originals - to verify a work is your own hand-made creation.

3.4 Consequence - your storefront will be taken down. If you list AI-generated art in breach of this clause, we will remove the offending work and your storefront will be suspended (taken offline and hidden from buyers). A first, clearly accidental breach may be resolved by removing the work and giving a warning at our discretion. Repeated or deliberate breaches, or misrepresenting how a work was made, will result in permanent removal from SOLENE HAUS and cancellation of your membership without refund. This is a condition of membership, not a guideline.

4. Membership and the no-commission principle

4.1 SOLENE HAUS charges zero commission on your sales. You connect your own Stripe account, buyers pay you directly, and you keep 100% of every sale and all shipping. We never touch a sale, a payout, or a parcel.

4.2 Our only revenue from you is a flat membership fee. Nothing about a sale of yours ever becomes revenue of ours.

4.3 You set your own prices, keep your buyers' details, and may link to your own website and social channels from your profile. Membership does not restrict where or for how much you sell your work elsewhere.

5. Membership fee, billing and the two ways to pay

5.1 Membership is AUD $29 per month, or AUD $319 per year. The annual option is twelve months for the price of eleven - you pay upfront and get one month free.

5.2 Monthly membership renews automatically each month; annual membership renews automatically each year. All fees are in Australian dollars and are charged through Stripe.

5.3 You can cancel at any time from your dashboard, effective at the end of the current billing period. We do not provide refunds for partial months, and annual (upfront) payments are non-refundable once the year has begun.

5.4 GST is included where applicable. We may change membership pricing with reasonable notice by email; a change never applies to a period you have already paid for.

6. If a payment fails

6.1 You will be notified. If a scheduled membership payment fails - most often an expired card or insufficient funds - we will email you straight away to let you know and to ask you to update your payment details.

6.2 Five-day grace period. You have five (5) days from the first failed payment to bring your membership up to date. During those five days your storefront stays live and nothing changes.

6.3 Suspension after five days. If your membership is still unpaid after the five-day grace period, your storefront will be suspended - taken offline and hidden from buyers - until payment is received. Nothing is deleted: your artworks, profile, orders, collector list and data all remain safe.

6.4 Automatic reinstatement. The moment your outstanding payment succeeds, your storefront is restored automatically and goes live again. You do not need to reapply.

7. Suspension and removal generally

We may suspend or remove a storefront where this Agreement or our Terms of Service is breached - including listing AI-generated art (clause 3), listing work that is not your own, or non-payment of membership (clause 6). Suspension hides your storefront; removal ends your membership. Where a breach is serious, deliberate, or repeated, we may act without prior warning and without refund.

8. Your content and our licence

You retain full copyright in your work. By listing on the platform you grant SOLENE HAUS a non-exclusive, royalty-free licence to display, reproduce and promote your work for the purposes of operating and marketing the platform. We never create prints of, resell, or license your work to third parties without your written permission.

9. Changes and governing law

We may update this Agreement from time to time and will notify you of material changes by email. This Agreement is governed by the laws of Victoria, Australia, and disputes are subject to the exclusive jurisdiction of the courts of Victoria, Australia.
